LEGAL SUPPORT OF STATE REGISTRATION OF COMMERCIAL REAL ESTATE ASSETS IN THE REPUBLIC OF BELARUS AND THE WAYS OF ITS ENHANCEMENT

Abstract

High level of the commercial real estate market development, which largely contributes to the implementation of one of the basic principles of the market economy – individual isolation and freedom of economic activity of economic agents is one of the essential conditions for the effective functioning of the economy on a national scale. The article substantiates the role of the state as the main subject of regulation of the real estate market and investigates, in particular, the legal support of the state registration of commercial real estate property in the Republic of Belarus. In accordance with the author’s concept of «commercial real estate market», the highlighted features of this market introduce the concept of «subject structure of the commercial real estate market», which is formed by means of combining diverse subjects of the commercial real estate market, taking into account the system of relationships between them, summarizing their goals, objectives, economic interests, methods and forms of organization and interaction concerning the movement of commercial real estate assets at different stages of the life cycle. Each element of the five blocks of the subject structure of the commercial real estate market of the Republic of Belarus is identified. The concept of «mechanism of state regulation of the real estate market» is given. The methods of direct administrative and economic regulation of the commercial real estate market are highlighted. The system of state organizations in the field of state registration in the Republic of Belarus is shown. The system of state registration of real estate in Belarus is considered, its goals are specified. The analysis of the current system of state registration allowed to highlight its shortcomings, which was the basis for the development of ways of its enhancement, including the use of GIS-technologies. The necessity to introduce such an innovative tool as the technical and economic uniform passport of the commercial real estate property is substantiated.
