PUBLICITY AS A PRINCIPLE OF LEGAL PRACTICE IN THE SECOND HALF OF THE 19TH CENTURY (BASED ON MATERIALS OF NOVGOROD PROVINCIAL GAZETTE AND COMMEMORATIVE BOOKS OF NOVGOROD PROVINCE)

Abstract

The article examines the practice of implementing the principle of publicity in the activities of law enforcement agencies in the Novgorod province after the 1864 Judicial Reform. The author analyzes the materials of the Novgorod Provincial Gazette and Commemorative Books of Novgorod Province in order to determine the degree of publicity of legal procedures, and information transparency of pre-trial proceedings. The study of search notices in periodicals allows us to assess the law enforcement practice of the county police departments. The Statistical Committee of Novgorod province regularly published reports on the state of crime, implementing the principle of publicity. The analysis of the implementation the legislation regulating the issues of publicity of judicial and search efforts by the provincial law enforcement agencies is carried out. If we compare characteristics and assessments of publicity degree in modern legal practice in the scientific literature, it is evident that the level of implementation of this principle after the 1864 Great Judicial Reform is still unachieved. It is noted that one should take into account periodicals as an invaluable source of information about legal institutions of the Russian Empire. Comprehensive analysis of 19th-century journal and newspapers contributes to the study of history of the legal system in Russia.
